UTICA — An off-duty Albany police officer won't face charges related to a fatal shooting Monday on Lincoln Avenue, Utica police say.

But Officer Christofer Kitto is charged with one count of patronizing a prostitute, which is a misdemeanor, police said.

Around 5 a.m. Monday, Utica police responded to 1303 Lincoln Ave. to investigate a report of shots fired. There, they found Shatelle Hooks, 35, of Syracuse, suffering from multiple gunshot wounds. He later died at the St. Elizabeth campus of the Mohawk Valley Health System.

Utica police Sgt. Michael Curley said it is believed that Hooks was "an acquaintance of a woman who lived at the residence."

Witnesses told police 34-year-old Kitto was the person who fired the shots. But police currently believe the incident was a "justifiable homicide," they said.

Kitto "was at the residence when, from witness interviews and existing forensic evidence, an altercation ensued," according to a release.

During that altercation, Hooks allegedly displayed a knife and demanded property from Kitto — who possessed more than $3,000 in cash — in an attempt to rob him.

"Upon being confronted with the knife, Kitto drew a weapon and shot Hooks several times, ultimately causing his death," the police department said in its release.

"At this stage of the investigation, pending new conflicting information or forensic evidence, the shooting appears to be a justifiable homicide, and no charges are being filed at this time with respect to the death of Shatelle Hooks," the release continues.

The investigation is ongoing, however. And, according to Albany police Public Information Officer Steven Smith, Kitto has been put on administrative leave while Utica police conduct their investigation.

Further, Albany police are conducting their own internal investigation relating to the incident, Smith said.

Kitto has been an officer with the Albany Police Department for five years.
