LENOX – The former owner of Syracuse Chimney and Stove is facing multiple felonies after he stole contents from the business that was seized by the New York State Department of Tax and Finance, according to the Madison County Sheriff’s Office.

On Feb. 5, agents from Tax and Finance seized 39-year-old David T. Van Marter’s business and all of the items within the building due to the East Syracuse resident owing state taxes, officials said.

After the building and its contents were seized, Van Marter unlawfully entered the building and stole property with an approximate value of $1,100, deputies said.

Van Marter was arrested Feb. 9 and was charged with third-degree burglary and fourth-degree grand larceny, deputies said.

Van Marter was arraigned at the Town of Lenox Court and was sent to Madison County Jail on $2,500 cash bail or $5,000 bond, officials said, and is scheduled to reappear at court Thursday, deputies said.
